Understanding packaging laws for cannabis and cannabis products
Packaging requirements for cannabis products are specific, and they can be a little confusing. We go over the basic rules for cannabis manufacturers who will need to keep these rules in mind for compliance.
The California Department of Public Health has issued packaging standards that all cannabis manufacturers (and others who may be packing cannabis and cannabis products) must adhere to.
Basic packaging requirements
Here are the basic packaging requirements for all cannabis and cannabis products.
Packaging cannot be:
- Attractive to children
- Easily confused with candy or other foods that do not contain cannabis
Packaging must be:
- Tamper evident
- Child resistant
Additionally, each cannabis product must have a unique track-and-trace ID that will help with identification and tracking as it moves through the system.
Basic labeling requirements
The label on cannabis products also has specific requirements. All manufactured cannabis products must have the following guidelines:
- Date of manufacturing
- Date of packaging
- Known allergens (nuts, etc.)
- Source of cultivation
- Date of cultivation
- Type of cannabis or cannabis product
- Number of servings per package
- Pharmacologically active ingredients (THC, CBD, etc) and its amount
- Universal symbol of cannabis
For medicinal cannabis, the product must be marked, "FOR MEDICAL USE ONLY"
And all packages must have the following government warning in bold print:
GOVERNMENT WARNING: THIS PRODUCT CONTAINS CANNABIS, A SCHEDULE I CONTROLLED SUBSTANCE. KEEP OUT OF REACH OF CHILDREN AND ANIMALS. CANNABIS PRODUCTS MAY ONLY BE POSSESSED OR CONSUMED BY PERSONS 21 YEARS OF AGE OR OLDER UNLESS THE PERSON IS A QUALIFIED PATIENT. THE INTOXICATING EFFECTS OF CANNABIS PRODUCTS MAY BE DELAYED UP TO TWO HOURS. CANNABIS USE WHILE PREGNANT OR BREASTFEEDING MAY BE HARMFUL. CONSUMPTION OF CANNABIS PRODUCTS IMPAIRS YOUR ABILITY TO DRIVE AND OPERATE MACHINERY. PLEASE USE EXTREME CAUTION.
While these requirements may seem excessive, it's crucial to adhere to them to remain in compliance of the law.
